Welcome to NexoMask. These Terms of Use constitute a legally binding agreement between you and NexoMask Inc. ("NexoMask", "we", "us") regarding your use of nexomask.com and our services. Please read them carefully.
1. Acceptance of Terms
By accessing or using NexoMask.com (the "Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you may not use the Service.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent that you are at least 18 and have the authority to bind any entity on whose behalf you act.
3. Account Registration
To access most features, you must register for an account. You agree to provide accurate information and keep it up-to-date. You are responsible for maintaining the confidentiality of your account credentials.
4. Orders and Payment
When you place an order through our Service, you agree to pay all applicable fees. Payment is processed through Stripe. All fees are in USD unless otherwise stated. Prices are subject to change.
5. Minimum Order Quantities (MOQ)
Each product has a specified MOQ. We reserve the right to cancel orders that do not meet MOQ requirements. Sample kit orders are exempt from MOQ requirements.
6. Shipping and Delivery
We ship via DHL, FedEx, or UPS. Delivery times are estimates and not guaranteed. Risk of loss passes to you upon delivery to the carrier (FOB Guangzhou unless otherwise agreed).
7. Returns and Refunds
Due to the custom nature of our products, returns are accepted only for defective items within 14 days of receipt. Sample kit purchases are non-refundable. To request a return, contact [email protected].
8. User Content
You retain ownership of content you submit (reviews, project files, designs). By submitting, you grant us a non-exclusive license to display and use your content on our Service. You warrant you have the rights to submit such content.
9. Prohibited Conduct
You agree not to: (a) use the Service for illegal purposes, (b) violate intellectual property rights, (c) post harmful or offensive content, (d) attempt to disrupt the Service, (e) use automated scraping tools, or (f) reverse engineer any portion of the Service.
10. Intellectual Property
The Service, including all content, software, and trademarks, is owned by NexoMask Inc. You may not use any of our intellectual property without our written permission.
11. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, NexoMask Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our aggregate liability is limited to the amount you paid us in the past 12 months.
13. Indemnity
You agree to indemnify and hold NexoMask Inc. harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
14. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration administered by the Singapore International Arbitration Centre (SIAC) under its rules. The arbitration shall take place in Singapore. This Agreement is governed by the laws of Singapore.
15. Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, all licenses granted to you will cease. Sections that by their nature should survive termination will continue to apply.
16. Modifications
We may modify these Terms at any time. Material changes will be communicated via email or notice on the Service. Continued use after changes constitutes acceptance of the modified Terms.
